(MP) site online is permitted only provided that the User agrees to and accepts the terms and conditions for use of the site that are set out below. Using or accessing this site without the User's acceptance of these terms and conditions is expressly prohibited and as such you, the User should ensure that you read and are fully familiar with the terms and conditions of use. Terms and conditions of use may from time to time change or be altered by MP and you should ensure that you are aware of such changes. MP expressly reserves the right at any time or times to alter, amend, add to, remove or modify any of the terms and conditions in its sole and absolute discretion. Your access to and use of the MP site confirms that you have read and considered the terms and conditions of use, and have agreed to be fully bound by them.

Restrictions On Use Of Materials

MP is the owner of all right title and intellectual property in the name "McGrath Pharmacies Inc" and is as such fully and expressly the property of MP, inclusive of all copyright therein. MP may from time to time use other trade names, trademarks, logos and web site names which are particular to or copyrighted by MP. As such, no trademark, copyright, trade name, web site name or other named identification of or owned by MP may be used without the specific written approval of MP and such approval may be unreasonably withheld. Trademarks, logos and or product names which may be referred to or displayed in any way by MP on its web site other than indicated as the property of MP are trademarks, product names and logos owned by entities other than MP. It is expressly understood and agreed by the user that no trademarks, trade names, logos, other copyrighted intellectual property or any of the material(s) whatsoever on this web site including but not limiting the generality thereof, graphic design, content text, font and colours whether the property of MP or otherwise can be used, reproduced, altered or transmitted by the user in any way other than expressly permitted herein, nor is it permitted to make any commercial use whatsoever of the material on the web site. The content, materials and information on the MP web site is solely and expressly for the educational use of the user and is meant to provide the user with some information with respect to a general knowledge of diverse and varied health subjects. This policy applies to the collection, use and disclosure of personal information in the course of all commercial dealings with MP, including pharmacy and retail services and applies to the use of any website or mobile application maintained by MP.

What is personal information?

Personal information is information about an identifiable person, such as their name, date of birth and e-mail address. Personal information also includes personal health information, such as your medical records and other information about your health and your prescriptions, that has been collected or generated by your pharmacist.

When you use MP services, you agree that MP may collect, use and disclose your personal information in accordance with this policy.


MP will collect, use and disclose personal information without your consent only in very limited circumstances as permitted by law such as disclosing it to a person who needs the information because an emergency threatens your life.


If you decide to withdraw your consent to allow MP to collect your personal information, we will still have to comply with all the provincial laws that require us to keep records relating to the medication that we dispensed to you. If you choose to not give us consent to disclose certain personal information, we may not be able to provide you with the full range of pharmacy services.

 

How we collect personal information

MP collects personal information directly from you when you sign up in order to provide you with service. This includes your contact information, health history, prescription history and insurance information. This information may be provided to MP in person, by phone, e-mail, fax or be submitted by you online.


In addition, when you use our website or mobile application, MP has access to the following information about you and your visit to these sites. Only some of these categories of information identify you directly, but each category offers some information about your interests and activities that could be used to make inferences about you.

IP Address. MP records the Internet Protocol (IP) address of your computer when you visit our website or mobile application. The IP address does not identify you personally, but it allows us to maintain communications with you as you move about the Sites.


Cookies. MP also collects information about your use of the website and mobile application through cookies and similar technology. MP is committed to protecting your personal information. You are allowed to access the personal information MP has about you and correct it where permitted by law. Our website and mobile application allows you to view the personal information MP has collected from you or about you. MP may charge a reasonable fee for providing you with copies of your personal information.

Jurisdiction

The user agrees and understands that notwithstanding the global nature of the internet and available access by the user to the MP web site from any location, that these terms and conditions shall be governed and interpreted by the laws of the Province of New Brunswick and Canada, and as such the user expressly attorns to the jurisdiction of the Courts of the Province of Brunswick. In the event that any of these terms and conditions are held to be indefinite, invalid, illegal or otherwise voidable or unenforceable, the balance of these terms and conditions will continue in full force and effect. These terms and conditions constitute the entire agreement between the user and MP governing use of the MP site.
